What is the drinking and driving limit in Virginia (Peters-burg area)?

we had an accident in virigina. they said the guy was drinking... I believe it to be true because the way everything happen.... but my dad was put at fault... and i reall y believe it was the other guy's fault... my dad wouldn't put his grandchildren and daugther life at risk... can someone tell me... we don't live in virigina so i don't know.
